Be.EV Subscription Terms & Conditions

1. Introduction 

1. These are the terms and conditions on which We provide Be.EV Subscriptions to You (“Subscription T’s and C’s”). These Terms & Conditions are mandatory for anyone purchasing a Be.EV Subscription, and You must accept them to hold any Be.EV Subscription.

2. Please be aware that these Subscription T’s and C’s only govern the Be.EV Subscriptions. Your use of the Charging Points and Our Services shall otherwise be governed by the Terms & Conditions of Service You entered into when signing up for an Account, a copy of which can be found here Terms & Conditions of Service | Be.EV.  

2. Eligibility 

1. have a valid Account and agree to these Subscription T&Cs;
2. agree to the Terms & Conditions of Service governing the use of the Charging Points and Our Service,
3. have legal capacity to enter into a binding contract with Us;
4. be located in a jurisdiction where the Be.EV Subscription requested is offered; 
5. have and maintain a valid, up-to-date method of payment linked to Your Account; and
6. not be in breach of any agreements with Us . 

3. Your Be.EV Subscriptions 

1. To purchase a Be.EV Subscription You should go to the charging subscriptions page on Our App and select the Be.EV Subscription that You wish to purchase. You will then be provided with the details of the Be.EV Subscription in question, and You will be able to confirm Your request for the Be.EV Subscription.  
2. By paying any recurring monthly subscription fees to keep Your Be.EV Subscription active, You can take advantage of any discounted charging rates, Allowance, or other offers set out in the Subscription Specifics applicable to Your Be.EV Subscription which can be used at Our participating Charging Sites. We reserve the right to make reasonable changes to the Subscription Specifics from time to time.
3. Please note that the Be.EV Subscription only applies to Our participating Charging Points. You may be charged standard tariff or fees for use of any other Charging Points. A list of Our participating Charging Points that relate to each of the Subscriptions is available on Our App.
4. There are certain circumstances where We may not be able to provide You with access to a Be.EV Subscription on Our App or at one or more of Our Charging Points. This might be because: 
   1. the owner of the relevant Charging Points no longer wishes to provide or participate in the Be.EV Subscription;
   2. there are issues with connectivity to the grid or telecommunications network at a one or more of Our Participating Charging Points;
   3. of there are technical difficulties on Our App, back-office, Our Charging Points or on Our resources which We could not reasonably plan for;  
   4. You no longer have a valid Account or up-to-date method of payment linked to Your Account;
   5. We have discovered that You do not meet, or have never met, the eligibility criteria specified in paragraph 2;
   6. We have identified an error in the price or description of the Be.EV Subscription in question.   

4. Signing Up 

5. Account Use 

1. You are not permitted to share Your Be.EV Subscription with any other individual or company.
2. Your Be.EV Subscription must only be used to activate charging sessions at Our participating Charging Points for a maximum of one (1) Electric Vehicle per monthly billing cycle. You are not permitted to use Your Be.EV Subscription to activate charging sessions at Our Charging Points for any other Electric Vehicle.
3. For Fixed Price Subscriptions, We reserve the right to apply a fair-use cap of 2,000 kWh per monthly billing cycle of Be.EV Subscription-price usage. After which, You may be charged the standard applicable tariff. 
4. For Allowance Subscriptions:
   1. Your Allowance included within Your Be.EV Subscription will be detailed in the Subscription Specification depending on which Subscription that You have purchased. You may use Your Allowance only at Our participating Charging Points. Once You have used Your Allowance, You will be charged a tariff for any further use by You of Our participating Charging Points during that monthly billing period (referred to as an Overage or Overflow tariff) – the applicable tariff will be detailed in the Subscription Specification;
   2. Your Allowance will reset monthly in line with Your billing cycle (for example, if Your Be.EV Subscription is billed on 10th of each month, Your Allowance will reset that day). 
   3. Your unused Allowance during any monthly billing period cannot be carried forward to a subsequent month and any unused Allowance at the end of the billing period will be lost. 
5. We are not responsible for any unauthorised use of Your Be.EV Subscription and We reserve the right to suspend or terminate Your Be.EV Subscription as a result. If We suspect that You are sharing Your Be.EV Subscription, We may suspend Your account while We investigate. If We find that You have breached these Subscription T’s and C’s We may cancel Your Be.EV Subscription with immediate effect and without refunding You for the remaining period of Your Be.EV Subscription.   

6. Subscription Fees 

1. Subject to Your right to cancel Your Be.EV Subscription in accordance with paragraphs 7(b) or (c), We will charge You the subscription fees which relate to the Subscription(s) You have taken (and as further set out in the Subscription Specifics) using the payment method linked to Your Account (or any updated details provided by You). The subscription fee includes VAT.
2. The first payment will be due the day You sign up (subscribe) for the Be.EV Subscription.  
3. Subsequent payments will be due on a reoccurring basis starting from the day after You first subscribe, the frequency and timing of payments will be specified in the Subscription Specifics. Subject to any cancellation of Your Be.EV Subscription, You further authorise Us to charge Your original payment method (or any updated details provided by You or Your bank in the event that You receive a new card) when due on a recurring basis with the relevant subscription fee as set out in the Subscription Specifics.  
4. If You do not make any payment to Us when it is due, Your Be.EV Subscription will immediately be cancelled (and We shall not refund You for the remaining period of Your Be.EV Subscription). 

7. Termination and renewal  

1. Once the Subscription period applicable to Your Subscription as specified in the Subscription Specifics has elapsed, Your Subscription will automatically renew and will continue unless cancelled by You or Us in accordance with these Subscription T’s and C’s (or expires if there is an agreed end date).  Each further Subscription period will be of the same duration as the initial Subscription period specified in the Subscription Specifics. You shall remain responsible To Us for payment of all recurring fees. 
2. Save where Your Be.EV Subscription involves a minimum commitment period, You can cancel Your Be.EV Subscription at any time. Cancellation will take effect at the end of the Be.EV Subscription period in which You cancel (or at the end of the minimum commitment period if applicable), and You can continue to use Your existing Be.EV Subscription until Your Be.EV Subscription period has expired. The recurring Be.EV Subscription fee will not be taken from You in the following Be.EV Subscription period. You will not receive a refund for any part of a period in which You cancel.  
3. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Regulations") You also have the right to cancel Your Be.EV Subscription, for any reason, within 14 days of the date of Your Be.EV Subscription starting (the “Cooling-off Period”).
4. If You wish to exercise Your right to cancel under either paragraph 7(b) or 7(c), You must contact Us to let Us know that You are doing so. You may do this by emailing Us at  support@be-ev.co.uk
5. If You exercise Your right of cancellation in accordance with paragraph 7(c) in the Cooling-off Period, Our contract with You will come to an end and We will reimburse to You the Subscription fee received from You for Your Be.EV Subscription. This may be £0 if Your Subscription included an initial free period.  We will use Our reasonable endeavours to make this reimbursement no later than 30 days after the day on which We are informed about Your decision to cancel Your Be.EV Subscription to the bank account linked to Your Account. Any charges incurred which relate to Your use of the Charging Points or Services (including but not limited to electric vehicle charging, penalties or fees) shall be at all times remain payable by You. 
6. We may withdraw the Be.EV Subscription at any time. We will use Our reasonable endeavours to notify You (via email) at least one month in advance, to let You know that We are going to stop providing the Be.EV Subscription. Our withdrawing the Subscription and will not take any subsequent recurring monthly subscription fees in respect of the withdrawn or terminated Be.EV Subscription.
7. You may transfer from Your current live Subscription to another Subscription product in Our App. By doing so, You will be charged the new Subscription price immediately and gain access to its benefits, and refunded for Your current subscription in proportion to Your usage (in the case of the Allowance Subscription) or period of time left in the relevant billing period (in the case of the Fixed Price Subscriptions). This means for Fixed Price Subscriptions, You will be refunded in proportion to how far through Your billing period You are. For Allowance Subscriptions, You will be refunded in proportion to how much of Your charging Allowance You have used in Your billing period.
8. We reserve the right to update, change, modify or terminate any or all of the Be.EV Subscriptions and these Subscription T’s and C’s: 
9. immediately on notice to You if:

1. 1.   there is a change in applicable law or regulation; or 
   2. You are in serious breach of these Subscription T&Cs; or
   3. You are in serious breach of any other agreements with Us, and We reasonably believe that such breach may prejudice the performance of Your obligations under these Subscription T&Cs; or
   4. You breach these, or any other, agreement with Us in a way which is not serious but is: (i) repeated; or (ii) not put right by You within 30 days of Us notifying You of the breach. 

ii. effective from the beginning of Your next monthly billing period (being the date on which Your next Subscription fee is due) if We need to change or cancel a Be.EV Subscription (including the price of any Subscription) and/or these terms and conditions for any other reason.  If You do not agree to any updates, changes or modifications You have the right to cancel a Be.EV Subscription by following the steps set out above in Paragraph 7 (b).

2. We are committed to protecting Your privacy and maintaining the security of any personal information received from You. Any data You submit to Us will be held by Us in accordance with Our Privacy Policy. Our Privacy Policy can be viewed at: Privacy Policy and Data Protection | Be.EV.
3. If any court or relevant authority decides that any of these Subscription T’s and C’s are unlawful, the remaining paragraphs will remain in full force and effect.
4. These Subscription T’s and C’s and any claims or disputes arising out of or connection with them are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
