Be.EV Subscription Terms & Conditions

Definitions

Save as is otherwise defined herein, the definitions in Our General Terms & Conditions of Service | Be.EV shall apply.

Be.EV Subscription(s) or  Subscription” means any or all of the subscriptions provided by Us, each of which can be accessed and subscribed for via the Our App.

“Subscription Specifics” means any details specific to an individual Be.EV Subscription as set out in the subscriptions page of Our App relating to the specific Be.EV Subscription in question;

  1. Introduction

a)        These are the Terms & Conditions on which We provide Be.EV Subscriptions to You. These Terms & Conditions are mandatory for anyone purchasing a Be.EV Subscription, and You must accept them to hold any Subscription. 

b)        Please be aware that these Terms & Conditions only govern the Be.EV Subscriptions. Your use of the Charging Points and Our Services shall otherwise be governed by the Terms & Conditions of Service You entered into when signing up for an Account, a copy of which can be found here Terms & Conditions of Service | Be.EV

  1. Eligibility

To be eligible for a Be.EV Subscription, You must: 

a)        have an Account and agree to these T&Cs;

b)        agree to the Terms & Conditions of Service governing the use of the Charging Points and Our Service,

c)        have legal capacity to enter into a binding contract with Us;

d)        be located in a jurisdiction where the Be.EV Subscription requested is offered; 

e)        have and maintain a valid, up-to-date method of payment; and

f)           not be in breach of any agreements with Us or any of Our Terms & Conditions (including these ones and any Subscription Specifics).

  1. Your Be.EV Subscriptions

a)        To purchase a Subscription You should go to the charging subscriptions page on Our App and select the Subscription that You desire. You will then be provided with the details of the Be.EV Subscription in question, and You will be able to confirm Your request for the Be.EV Subscription. 

b)        By paying any recurring monthly subscription fees to keep Your Be.EV Subscription active, You can take advantage of any discounted charging rates or other offers set out in the Subscription Specifics. We reserve the right to make reasonable changes to the Subscription Specifics from time to time.

c)        There are certain circumstances where We will not be able to provide You with a Be.EV Subscription on Our App. This might be:  

                                                                                    i.                  because any or all Be.EV Subscriptions may no longer be available; 

                                                                                 ii.                  because the owner of the relevant Charging Points no longer wishes to provide or participate in the Subscription;

                                                                              iii.                  because of unexpected limits on Our resources which We could not reasonably plan for;  

                                                                              iv.                  because You do not have an Account;

                                                                                 v.                  because You have not agreed to the Terms & Conditions of Service;

                                                                              vi.                  because You do not agree to these Terms & Conditions;

                                                                           vii.                  because We have discovered that You do not meet, or have never met, the eligibility criteria specified in paragraph 2;

                                                                         viii.                  because We have identified an error in the price or description of the Be.EV Subscription in question.  

  1. Signing Up

a)        Once We have accepted Your Be.EV Subscription You will receive an email confirming that Your Be.EV Subscription has been set up successfully. Once You have received Your confirmation email, You can use Your Be.EV Subscription straight away by charging at a valid Charging Point.

  1. Account Use

a)        You are not permitted to share Your Be.EV Subscription with any other individual or company.

b)        Your Be.EV Subscription must only be used to activate charging sessions at Charge Points for a maximum of one (1) Electric Vehicle per monthly billing cycle. You are not permitted to use Your Subscription to activate charging sessions at Charging Points for any other Electric Vehicle.

c)        We reserve the right to apply a fair-use cap of 2,000 kWh (per monthly billing cycle) of Subscription-price usage. After which, You may be charged the standard applicable tariff. We are not responsible for any unauthorised use of Your Be.EV Subscription and We reserve the right to suspend or terminate Your Be.EV Subscription as a result. If We suspect that You are sharing Your Be.EV Subscription, We may suspend Your account while We investigate. If We find that You have breached these Terms & Conditions We may cancel Your Be.EV Subscription with immediate effect and without refunding You for the remaining period of Your Be.EV Subscription.  

  1. Subscription Fees

a)    Subject to Your right to cancel Your Be.EV Subscription in accordance with paragraphs 7(b) or (c), We will charge You the subscription fees which relate to the Subscription(s) You have taken (and as further set out in the Subscription Specifics) using the payment method linked to Your Account (or any updated details provided by You). The subscription fee includes VAT.

b)    The first payment will be due the day You sign up (subscribe) for the Be.EV Subscription.  

 

c)         Subsequent payments will be due on a reoccurring basis starting from the day after You first subscribe, the frequency and timing of payments will be specified in the Subscription Specifics. Subject to any cancellation of Your Be.EV Subscription, You further authorise Us to charge Your original payment method (or any updated details provided by You or Your bank in the event that You receive a new card) when due on a recurring basis with the relevant subscription fee as set out in the Subscription Specifics.

d)        If You do not make any payment to Us when it is due, your Be.EV Subscription will immediately be cancelled (and We shall not refund You for the remaining period of Your Be.EV Subscription).

  1. Termination and renewal 

a)        Once the subscription period applicable to Your Subscription as specified in the Subscription Specifics has elapsed, Your Subscription will automatically renew and will continue unless cancelled by You or Us in accordance with these Terms & Conditions (or expires if there is an agreed end date).  Each further subscription period will be of the same duration as the initial subscription period specified in the Subscription Specifics, . You shall remain responsible To Us for payment of all recurring fees. 

b)        Save where Your Be.EV Subscription involves a minimum commitment period, You can cancel Your Be.EV Subscription at any time. Cancellation will take effect at the end of the Subscription period in which You cancel (or at the end of the minimum commitment period if applicable), and You can continue to use Your existing Subscription until Your subscription period has expired. The recurring subscription fee will not be taken from You in the following Subscription period. You will not receive a refund for any part of a period in which You cancel.  

c)        Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the "Regulations") You also have the right to cancel Your Be.EV Subscription, for any reason, within 14 days of the date of Your subscription starting (the “Cooling-off Period”).

d)        If You wish to exercise Your right to cancel under either paragraph 7(b) or 7(c), You must contact Us to let Us know that You are doing so. You may do this by emailing Us at  support@be-ev.co.uk

e)        If You exercise Your right of cancellation in accordance with paragraph 7(c) in the Cooling-off Period, Our contract with You will come to an end and We will reimburse to You the subscription fee received from You for Your Be.EV Subscription. This may be £0 if Your subscription included an initial free period.  We will use our reasonable endeavours to make this reimbursement no later than 30 days after the day on which We are informed about Your decision to cancel Your Be.EV Subscription to the bank account linked to Your Account. Any charges incurred which relate to Your use of the Charging Points or Services (including but not limited to electric vehicle charging, penalties or fees) shall be at all times remain payable by You. 

f)           We may withdraw the Be.EV Subscription at any time. We will use our reasonable endeavours to notify You (via email) at least one month in advance, to let You know that We are going to stop providing the Be.EV Subscription  Our withdrawing the Subscription and will not take any subsequent recurring monthly subscription fees in respect of the withdrawn or terminated Be.EV Subscription.

g)         We reserve the right to update, change, modify or terminate any or all of the Be.EV Subscriptions and these Terms & Conditions: 

                                                                                    i.                  immediately on notice to You if:

1.        there is a change in applicable law or regulation; or 

2.        You are in serious breach of these T&Cs; or

3.        You are in serious breach of any other Terms and Conditions or agreements with Us, and We reasonably believe that such breach may prejudice the performance of Your obligations under these T&Cs; or

4.        You breach these, or any other, Terms and Conditions in a way which is not serious but is: (i) repeated; or (ii) not put right by You within 30 days of Us notifying You of the breach.

                                                                                 ii.                  effective from the beginning of Your next renewal period if We need to change or cancel a Be.EV Subscription (including the price of any Subscription) and/or these terms and conditions for any other reason.  If You do not agree to any updates, changes or modifications You have the right to cancel a Be.EV Subscription by following the steps set out above in Paragraph 7 (b).

  1. Our Liability

a)        Our liability to You is limited and shall be governed by Our General Terms & Conditions that You entered into when signing up for an Account.

b)        We are committed to protecting Your privacy and maintaining the security of any personal information received from You. Any data You submit to Us will be held by Us in accordance with Our Privacy Policy. Our Privacy Policy can be viewed at: Privacy Policy and Data Protection | Be.EV

c)        If any court or relevant authority decides that any of these Terms and Conditions are unlawful, the remaining paragraphs will remain in full force and effect. 

d)        These terms and conditions are governed by English law under the exclusive jurisdiction of the courts of England and Wales.
